Terms of Service
Last updated · 7 October 2026
These Terms of Service (“Terms”) govern your use of the Dreamers Media website (www.dreamersmedia.co.za) and the services we provide. By engaging Dreamers Media, you agree to these Terms.
Your accepted quote sets out your package, scope, price and payment terms. Where your quote says something different from these Terms, the quote takes precedence.
1. About Dreamers Media
Dreamers Media (“we”, “us”, “our”) is a South African business that builds websites and AI agents for startups and small businesses.

2. Services
Services are scoped per client through a written quote. They may include, but are not limited to:
- Websites. A strategy session, website plan, custom design, the words written for you, the enquiry flow, search basics, rounds of changes, launch and support.
- AI agents. An AI workspace set up on your computer, a brand session, AI agents that each take one job off your plate, training and a check-in.
- Packages that combine a website and AI agents.
Our current packages and starting prices are on our website. The exact scope, deliverables and timelines for your project are in your quote.
3. AI agents
3.1 Our agents change. We add, improve, replace and retire agents as the technology moves. Your package includes the agents listed in your quote on the day you accept it. If one is replaced before delivery, you get one that does the same job. Agents released later are not included unless your quote says so.
3.2 You need your own AI subscription. Our agents run on an AI platform, not on Dreamers Media systems. You must have your own paid subscription, in your own name. We recommend Claude by Anthropic, and we build our agents for it. We tell you which plan you need before you buy. Your subscription is between you and the provider, under its terms. We do not resell AI subscriptions.
3.3 Some agents need other paid services. Some agents use outside tools to do their job. For example, our market research agent uses Apify to collect business listings and reviews from Google Maps. You open these accounts in your own name and pay the provider directly. Before you buy, we tell you which services your agents need and what they are likely to cost. Those costs are estimates. Most are charged by usage, often in US dollars, and providers can change their prices.
3.4 Outside services change. AI platforms and tools change their features, prices and limits, and some shut down. We do not control this. If a change breaks an agent during your support period, we fix or adapt it where that is reasonably possible. After that, fixes are quoted.
3.5 You review and approve everything. Agents produce drafts and suggestions. AI makes mistakes: it can get facts wrong or make things up. You check and approve everything before you publish, send or act on it.
3.6 Information your agents collect. Some agents collect public information, such as business listings and customer reviews, which can include personal information. They do it through your accounts, for your business, so you are responsible for it under POPIA. Use it for your own market research only. Do not use collected contact details for cold marketing unless the law allows it.
4. Engagement process
Projects proceed in this order unless your quote says otherwise:
- Discovery call.
- Quote sent for review.
- Quote and these Terms accepted in writing or at checkout.
- Payment made by EFT, or by card through a secure payment provider (PayFast, Bob Pay or Paystack), using a payment link or an online checkout.
- Onboarding form completed and access shared.
- Work begins: Discover, Plan, Build, Refine, Launch.
No work starts before payment reflects. By paying, you ask us to start straight away. Our Refund and Cancellation Policy explains what that means for your cooling-off rights.
5. Fees and payment
- All fees are in South African Rand (ZAR).
- Website: paid in full before work starts.
- Startup Pack: 50% deposit to start, 50% before launch. Pay in full upfront and get 10% off.
- AI Agents Pack: paid in full upfront.
- Larger quoted projects: as set out in the quote, usually 40% to start, 40% on design approval and 20% before launch.
- The final payment is due within 7 days of us telling you the work is ready. We do not launch your site, hand over logins or install agents until it is paid.
- Monthly services are invoiced in advance and payable on receipt.
- Late payment may result in work and support being paused until the account is up to date. Overdue amounts carry interest at the prescribed rate.
- Promotions and special offers carry their own terms, shown with the offer. Where those differ from these Terms, the offer's terms apply to that purchase.
- Quotes are valid for 14 days.
- You pay all third-party costs unless your quote bundles them: domains, hosting, AI subscriptions, agent tools such as Apify, API usage, stock images and ad spend.
6. Client responsibilities
You agree to:
- Provide accurate information, brand assets and the access we need.
- Give feedback within 5 business days. Your package includes two rounds of changes. Further changes are quoted per client, after discovery.
- Keep your domain, hosting, AI subscription and agent tools in your own name, active and paid.
- Hold proper authority for every account, platform and asset you share with us.
- Follow the law and the terms of the platforms you use, including POPIA for your own customers.
- Review AI output before you use it.
If we hear nothing from you for 14 days, the project pauses. After 30 days we may close it and invoice the work done. Restarting a closed project is quoted separately.
7. Intellectual property
- Pre-existing intellectual property stays with its original owner. Your logo, photos and content stay yours.
- Your website design and the words we write for it become yours on full payment.
- Our AI agents, prompts, workflows, templates and methods remain ours. On full payment you get a permanent licence to use the agents we install for you in your own business. You may adjust them for your own use, but you may not resell, share or publish them.
- What your agents produce for you is yours.
- Themes, plugins, fonts, stock images and software belong to their owners and are used under their licences.
- Until you have paid in full, the work remains ours.
- We may show your project in our portfolio and marketing unless you ask us not to in writing.
8. Confidentiality
Both parties keep confidential any non-public information shared during the engagement. This survives the end of the engagement.
9. Results and disclaimer
We commit to doing the agreed work with care and skill. We do not guarantee business outcomes: search rankings, visitors, leads, sales, followers or time saved. These depend on things outside our control, including your market, your offer and the platforms you use.
10. Limitation of liability
Please read this clause carefully.
To the fullest extent the law allows, our total liability arising from any engagement is limited to the fees you paid us under the quote the claim relates to. We are not liable for indirect or consequential loss, such as lost profit or lost data. We are not liable for outages, changes or charges by outside services, for AI output you used without checking, or for changes others make to our work after handover.
Nothing in these Terms limits liability for gross negligence or takes away your rights under the Consumer Protection Act.
11. Cancellation and termination
You may cancel in line with our Refund and Cancellation Policy. Either party may end an engagement if the other breaks these Terms and does not fix it within 7 days of written notice. When an engagement ends:
- Fees for work done become payable immediately.
- We hand over the work you have paid for.
- Each party returns or destroys the other’s confidential information.
- The clauses on confidentiality, intellectual property and liability continue to apply.
12. Personal information
Our Privacy Policy explains how we handle your personal information. When we handle your customers’ information for you, such as enquiries from your website, we use it only on your instructions and keep it secure.
13. Using this website
The content on this website is ours. Do not copy it without permission. It is general information, not professional advice. We do not promise the site will always be available or free of errors. Do not try to hack, overload or scrape it.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows the latest change. The version in force when you accept a quote applies to that project.
15. Complaints and governing law
Send complaints to [email protected]. We acknowledge them within 5 business days and aim to resolve them within 15 business days. If the Consumer Protection Act applies to you, you may also approach the National Consumer Commission. These Terms are governed by South African law, and disputes are resolved in the South African courts.
